Preznt Terms of Use

These Terms of Use ("Terms") govern access to and use of Preznt, a workforce time tracking and attendance product provided by NexC Solutions LLC ("NexC Solutions", "we", "us", or "our"). By using Preznt, you agree to these Terms.
1. Product and Developer
Preznt is developed and operated by NexC Solutions LLC, a Tennessee, United States software company. Preznt may be provided through mobile applications, web dashboards, APIs, cloud services, and related support services.
2. Users and Company Accounts
Preznt is intended for business use by companies, administrators, supervisors, employees, contractors, and other authorized workforce users. If your account is connected to an employer or company, your use may also be governed by that organization's policies, employment rules, and administrator settings.
3. Account Responsibilities
- You must provide accurate account information and keep it current.
- You are responsible for maintaining the confidentiality of your login credentials.
- You may not share your account, impersonate another person, falsify attendance records, or submit misleading work records.
- You must promptly notify us or your company administrator if you believe your account has been compromised.
4. Attendance, Location, Photos, and Notes
Preznt may allow users to record clock-in and clock-out times, GPS work zone verification, photo evidence, work notes, shift data, and related activity. You agree that information submitted through Preznt should be accurate, job-related, and authorized by your employer or company.
Company administrators and supervisors may access work-related records associated with your account. NexC Solutions is not responsible for employment decisions, disciplinary actions, payroll decisions, or workplace policies made by your employer or company.
5. Acceptable Use
You agree not to:
- Use Preznt for unlawful, abusive, fraudulent, or unauthorized purposes.
- Attempt to bypass geofence, security, authentication, billing, or access controls.
- Upload malicious code, unlawful content, or content that violates another person's rights.
- Interfere with the availability, integrity, or security of Preznt.
- Reverse engineer, scrape, resell, or commercially exploit Preznt except as permitted by a written agreement.
6. Subscriptions and Billing
If Preznt paid plans are enabled, billing may be handled by Stripe, app stores, or another authorized payment provider. Fees, billing periods, taxes, renewals, cancellations, and refunds may depend on the plan, store, or agreement selected by the company customer.
Payment card information is processed by the applicable payment provider and is subject to that provider's terms and privacy policy.
7. Privacy
Our collection and use of personal information is described in the Preznt Privacy Policy. By using Preznt, you acknowledge that work-related records may be made available to authorized company administrators and supervisors.
8. Service Changes and Availability
We may update, modify, suspend, or discontinue parts of Preznt from time to time. We work to maintain reliable service, but we do not guarantee that Preznt will always be uninterrupted, error-free, or available at all times.
9. Intellectual Property
NexC Solutions owns Preznt, including its software, design, branding, documentation, and related intellectual property. These Terms do not transfer ownership rights to you or your company.
10. Disclaimers
Preznt is provided "as is" and "as available" to the maximum extent permitted by law. NexC Solutions disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.
11. Limitation of Liability
To the maximum extent permitted by law, NexC Solutions will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, employment decisions, or payroll disputes arising from use of Preznt.
12. Termination
We may suspend or terminate access to Preznt if we believe a user or company has violated these Terms, created security risk, failed to pay applicable fees, or used the service unlawfully. You may stop using Preznt at any time, subject to your employer's policies and any active company agreement.
13. Governing Law
These Terms are governed by the laws of the State of Tennessee, United States, without regard to conflict of law rules, unless a separate written agreement states otherwise.
